Welcome to TravelMedX (“we,” “us,” “our,” “Platform”). These Terms & Conditions (“Terms”) govern your access to and use of our website, services, and content (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Definitions
User / You / Your: Any person or entity accessing or using the Services, including patients, providers, or visitors.
Provider: Healthcare institutions, clinics, hospitals, medical professionals, or third-party entities listed on the Platform offering medical or related services.
Content: Text, images, data, videos, listings, reviews, or other materials available through the Platform.
Booking / Appointment: The arrangement made via the Platform for medical consultations, treatments, travel, or related services.
2. Use of Services
2.1 Eligibility
You must be at least 18 years old (or legal age in your jurisdiction) to use the Services.
2.2 Account Registration
To access certain features, you may register for an account. You represent and warrant that all information you provide is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials.
2.3 Permitted & Prohibited Uses
You agree to use the Services only for lawful purposes and in a manner consistent with these Terms. You shall not:
Violate any applicable law or regulation;
Infringe any third-party rights (e.g. intellectual property, privacy);
Transmit harmful code (viruses, malware);
Engage in fraudulent, misleading, or manipulative behaviors;
Use automated scripts, scrapers, or data mining on the Platform.
3. Content & Intellectual Property Rights
3.1 Ownership
All content and materials on the Platform (unless otherwise credited) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
3.2 License to Users
We grant you a limited, non-exclusive, non-transferable license to access and use the Platform for your personal or professional use, subject to these Terms.
3.3 User-Generated Content
You may submit reviews, feedback, photos, or other content (“User Content”). You retain rights to your User Content, but by submitting it you grant us a worldwide, royalty-free, non-exclusive license to host, use, reproduce, modify, publish, translate, distribute, and display it in connection with our operations.
We reserve the right, but not the obligation, to monitor, edit, or remove any User Content that violates these Terms.
4. Booking, Payments & Cancellations
4.1 Third-Party Providers
When you make a booking through the Platform, you acknowledge that TravelMedX acts as a facilitator between you and the selected Provider. The actual medical services, payments, and treatment are the responsibility of the Provider.
4.2 Payment Terms
You agree to pay all fees charged by the Provider and any applicable taxes, according to the terms agreed upon at booking. Payment methods may include credit card, bank transfer, or other payment services.
4.3 Cancellation & Refunds
Cancellation policies vary by Provider. You should review the Provider’s cancellation & refund policy before booking. In some cases, refunds may be partial or withheld depending on timing, costs incurred, or non-refundable deposits.
5. Disclaimers & Limitations of Liability
5.1 No Medical Advice
The content on the Platform is for informational purposes only and does not constitute medical or professional advice. Always seek professional medical advice from a qualified healthcare provider.
5.2 Assumption of Risk
Travel, medical treatments, surgeries, and related procedures carry inherent risks. You assume full responsibility for any outcomes, complications, or consequences.
5.3 Limitation of Liability
To the maximum extent permitted by law, TravelMedX (and its affiliates, officers, employees, agents) shall not be liable for:
Indirect, incidental, consequential, punitive, or special damages;
Loss of profits, data, goodwill, or reputation;
Claims arising out of your use of the Platform, bookings, or medical treatments.
In any event, our maximum aggregate liability will not exceed the total amount you paid via the Platform in the prior twelve months (if applicable).
6. Indemnification
You agree to indemnify, defend, and hold harmless TravelMedX and its affiliates, officers, agents, and employees from and against any claims, demands, liabilities, damages, losses, or expenses (including attorney’s fees) arising out of or in connection with:
Your use of the Platform;
Your violation of these Terms;
Your User Content;
Your negligent or wrongful acts or omissions.
7. Privacy & Data Protection
Your use of personal data through the Platform is governed by our Privacy Policy, which is incorporated herein by reference. By using the Platform, you consent to our collection, use, and disclosure of personal data as described in the Privacy Policy.
8. Modifications to Terms
We may revise, add to, or remove portions of these Terms at any time, at our sole discretion. The revised Terms will be posted on this page with an updated “Last updated” date. Your continued use of the Platform after such modifications constitutes acceptance of the new Terms.
9. Termination
We may suspend or terminate your account or access to the Platform at any time and for any reason (or no reason), with or without notice. Upon termination, you must cease all use of the Platform, and all licenses granted to you will immediately terminate.
Sections which by their nature should survive (e.g., Sections on disclaimers, indemnification, intellectual property, etc.) will survive any termination of these Terms.
10. Governing Law & Dispute Resolution
These Terms will be governed by and construed in accordance with the laws of [Jurisdiction] without regard to conflict of law principles.
